1. Buried and above ground services identification:
The client is responsible for the identification of buried services to Malmow landscaping and plant hire . Malmow landscaping and plant hire will conduct a ground survey prior to the start of works and any costs associated with this are included in the price quoted.
2. Indemnity:
The client shall indemnify Malmow Landscaping and Plant Hire of all liability with regards to cost of repairs to buried services / property or personal injury should they be disrupted / damaged / occur due to excavation works.
3. Enquiry basis:
This enquiry is based on visible ground & access conditions advised by client, any changes found different to that advised at time of enquiry may be subject to adjustment with regards to time and / or cost, this will be discussed and agreed verbally with the client prior to continuation of works.
4. Variations:
A formal variation will be detailed to the client within verbally agreed timescales to which the client shall formally reply within 24 hours thereby providing their consent to the variation to time and / or cost.
5. Payments:
Labour / Plant and Material costs supplied by contractor:
- Material costs to be paid in full by the client prior to works commencing.
- 25% of the total labour & plant hire / waste disposal costs prior to works commencing, this will be refundable should a dispute occur and no works have been undertaken.
- 50% of the total labour & plant hire / waste disposal costs at the mid point of the works or agreed milestones.
- Final 25% of the total labour & plant hire / waste disposal costs shall be made in full by the client fourteen daysfrom completion of works.
Materials supplied by client – Labour & Plant / waste disposal costs only supplied by contractor:
- 25% of the total labour & plant hire / waste disposal costs prior to works commencing, this will be refundable should a dispute occur and no works have been undertaken.
- 50% of the total labour & plant hire / waste disposal costs at the mid point of the works or agreed milestones.
- Final 25% of the total labour & plant hire / waste disposal costs shall be made in full by the client fourteen days from completion of works.
6. Fixed price or day rate:
The works are based on a maximum 8 hour working day inclusive of daily travel, equipment delivery to site and removal of equipment from site, hours in excess of this may be worked at the discretion of the supplier on a case by case basis and shall be agreed with the client.
